18Excise on waterpipe tobacco
Portugal's excise code (Código dos Impostos Especiais de Consumo) treats waterpipe tobacco separately from other smoking tobacco. Article 104-B states that the tax takes the form of an ad valorem tax, resulting from applying a single percentage to the retail selling price, and the rate is 75%. Legal databases record an increase from 50% to 75% at the start of 2023.
Because the tax is a share of the retail price, it rises with the shelf price and cannot be estimated from weight alone. Ask your Portuguese importer how the retail price will be declared, who is the tax debtor for each shipment, and compare quotations on a tax-paid basis. Confirm the rate in force on the date of import, because the State Budget can change it.

Lei 37/2007, the main Portuguese tobacco act, defines waterpipe tobacco in article 2 as a tobacco product that can be consumed through a waterpipe and treats it as smoking tobacco, unless the product can be used both in waterpipes and as roll-your-own tobacco, in which case it is treated as roll-your-own tobacco.
Article 11-B requires each unit pack and outer pack of smoking tobacco, expressly including waterpipe tobacco, to show combined health warnings: one text warning with the matching colour photograph, including smoking-cessation information, covering 65% of the front and back. The warnings are grouped in three series used in annual rotation. Article 13 prohibits label elements that refer to taste, odour or flavourings and those that resemble a food or cosmetic product, so flavour names and fruit imagery need legal review before printing.

Article 10-A bans tobacco products with a distinctive aroma, but paragraph 10 states that this prohibition does not apply to tobacco products other than cigarettes and roll-your-own tobacco.
