09Shipping wholesale and bulk shisha tobacco to Spain

18Excise on shisha tobacco in Spain

Article 56 of the Special Taxes Law (Ley 38/1992) lists the four groups of tobacco products: cigars and cigarillos, cigarettes, rolling tobacco and 'the other smoking tobaccos'. Article 59 defines smoking tobacco as cut or otherwise divided tobacco that can be smoked without further industrial processing, and rolling tobacco as smoking tobacco where more than 25% by weight of the particles are cut narrower than 1.5 mm. Waterpipe tobacco is not named. On these definitions it is normally 'other smoking tobacco' rather than rolling tobacco, but a finely cut product should be checked with a customs broker.

Article 60 sets the rate for the other tobacco products at 34% of the maximum retail price, with a single minimum of 30 EUR per kilogram where the percentage would give less. The maximum retail price means the price in tobacconists in the Peninsula or Balearic Islands, taxes included. Manufacturers and importers report their maximum prices before marketing (article 58). The excise applies in the Peninsula and the Balearic Islands only.

19Who may import and how prices and labels are reported

The CMT guide for wholesale operators explains that under Law 13/1998 and Royal Decree 1199/1999 manufacturing, importing, exporting and distribution of tobacco are liberalised activities, while retail is a monopoly run through the network of tobacconists and authorised surcharge points. An operator registers in the CMT Operators Register by a responsible declaration; once registered it may operate in Spain, except the Canary Islands, indefinitely, on condition of continuing compliance. The guide also describes a procedure for occasional imports of small quantities under article 4.2 of Royal Decree 1199/1999. A CMT circular of 2019 sets the model for reporting retail prices and the labelling, packaging and presentations of tobacco products.

For an exporter this means selling to a registered Spanish operator, or asking whether the customer itself is registered, and agreeing early who reports the price and the presentation.

20Warnings, flavours and pack rules

Royal Decree 579/2017 transposes the EU directive. Waterpipe tobacco follows the same picture-warning regime as cigarettes and rolling tobacco: the CMT guide states that other smoking tobacco is exempt from the colour photographs and the cancer message, which shows that waterpipe tobacco is not. The warnings cover 65% of the front and back, must be printed indelibly and are rotated in yearly sets. Article 5.3 exempts tobacco products other than cigarettes, rolling tobacco and heated tobacco from the flavour ban, so waterpipe flavours are not banned by that article. Manufacturers and importers must give ingredient information (article 6). The minimum pack sizes in article 20 are set for cigarettes and rolling tobacco. National rules can change, so confirm the current text before you finalise artwork.
