18Tobacco tax on shisha tobacco in Germany

Under section 2 of the Tobacco Tax Act (TabStG), shisha tobacco is taxed at the pipe tobacco rate and then a separate surcharge for waterpipe tobacco is added. The surcharge has risen every year: 15 EUR per kilogram in 2022, 19 EUR in 2023 and 2024, 21 EUR in 2025 and 23 EUR from 1 January 2026. Because part of the tax is a percentage of the retail price, the total per kilogram depends on the price printed on the tax stamp.

In practice this means that tax, not the tobacco itself, is the largest cost element of a pack sold in a German shop. Compare offers on the basis of the tax-paid price, and ask who is the tax debtor in each shipment.

19The 25 gram pack rule and tax stamps

Since 1 July 2022 waterpipe tobacco may be sold to consumers only in retail packs of at most 25 grams (section 31 TabStG). Each pack must carry a German tax stamp that shows the retail price. German customs guidance to shops states that the stamp must be affixed at the opening point so that the tobacco cannot be removed without visibly damaging the stamp or the pack, that packs with more than one opening are not allowed, and that the product must be sold at the price on the stamp.

Larger consumer packs of shisha tobacco, and packs without a stamp, cannot be supplied to German retail. Bulk cut leaf or base for a German manufacturer is a different route and is handled under the manufacturing rules below.

20Manufacturing, mixing and multi-component products

German customs treats mixing components into a new waterpipe tobacco as manufacturing. It may only take place under duty suspension in a tax warehouse (Steuerlager), which needs a permit from the responsible Hauptzollamt. In a 2023 information note customs also warned that selling a taxed pipe-tobacco component together with a glycerine or molasses component, so that the consumer mixes them, is being used to avoid the 25 gram rule and the surcharge, and that it can amount to tax evasion by the consumer and the trader.

Even re-moistening tobacco with glycerine or molasses in a shop, without permission, is treated as manufacturing. Buyers who plan blending, re-packing or so-called two-component systems in Germany should take advice from their Hauptzollamt before placing an order.

21Health warnings and product rules under EU law

Germany applies the EU Tobacco Products Directive 2014/40/EU. The Commission summarises the main duties: combined health warnings with picture, text and cessation information on 65% of the front and back of the pack, reporting of ingredients through the EU Common Entry Gate, and EU-wide tracking and tracing. The directive's ban on characterising flavours covers cigarettes and roll-your-own tobacco, not waterpipe tobacco. Because national implementing law can add duties, confirm the current German text before you finalise pack artwork.
