18Classification and excise duty
HMRC's classification guidance places waterpipe tobacco under subheading 2403 11, a mixture of tobacco with molasses or sugar and flavourings such as fruit, glycerol or aromatic oils. It also states that whether excise duty applies, and at what rate, does not depend on the commodity code but on the Tobacco Products (Descriptions of Products) Order 2003. HMRC's rate table for 26 November 2025 lists other smoking and chewing tobacco at 193.87 GBP per kilogram, and announces a further increase from 1 October 2026; buyers should use the rate in force on the date of import.
Duty becomes payable when the goods arrive in the UK. It can be deferred when they are delivered to an approved excise warehouse, and HMRC's import guidance sets out separate routes for Great Britain and for Northern Ireland, which follows EU excise movement rules. Importers also pay customs duty and VAT.
19Product notification
Under the Tobacco and Related Products Regulations 2016, anyone who manufactures tobacco for smoking, puts their name or trademark on it, or imports it into the UK must notify the products to the UK competent authority, OHID, before they can be sold. Trading Standards guidance advises retailers to check that shisha products appear on the notified list, and notified products that are later withdrawn cannot be supplied.

Trading Standards' Business Companion states that shisha must carry combined health warnings with text and colour photographs and that it is not subject to standardised packaging, which covers cigarettes and hand-rolling tobacco. The same guide states that packaging must not refer to taste, smell, flavourings or additives, so flavour names and imagery on labels should be checked with the buyer's compliance adviser before artwork is printed.
21Track and trace
The UK tobacco track and trace system began for cigarettes and hand-rolling tobacco on 1 April 2019 and, from 20 May 2024, applies to anyone who buys, sells, stores or transports other tobacco products such as cigars, cigarillos, pipe tobacco and snuff. HMRC's scope page does not name waterpipe tobacco, whereas Trading Standards' guide states that shisha unit packets need unique identifiers and security features. Until HMRC confirms otherwise for your product, plan for unique identifiers on each unit pack and register with the identifier issuer. HMRC's import guidance says importers must follow the track and trace rules. Fiscal marks are a separate requirement that applies to cigarettes and hand-rolling tobacco.
