18Tobacco tax on shisha tobacco in Denmark

Section 2, number 30 of the Danish tobacco act defines waterpipe tobacco as a tobacco product that can be used in a waterpipe and states that, for the purposes of the act, it is smoking tobacco. The Ministry's rate page for the Tobacco Tax Act shows smoking tobacco at 1,500.90 DKK per kg for coarse-cut and 1,550.90 DKK per kg for fine-cut, the same in 2026 and 2027.

The Danish tax agency's guidance says the tax is calculated on the full weight of the product, for example 0.085 kg multiplied by 1,550.90 DKK for an 85 gram pack of fine-cut tobacco. Moist shisha tobacco therefore carries tax on its whole weight, including any molasses or glycerine. The guidance we reviewed does not say whether a given shisha product is coarse-cut or fine-cut, so ask your Danish consignee or a customs broker which rate applies to your cut.

Denmark also taxes products that copy shisha tobacco without tobacco. A ruling recorded in the tax agency's legal guidance treated a synthetic shisha product as smoking tobacco, and it names the authorised warehouse keeper (oplagshaver) as the tax debtor when goods move under duty suspension. Agree with your Danish customer who holds that authorisation before you ship.

19Standardised packs and health warnings

Section 21 a of the tobacco act requires every unit pack and outer pack of a tobacco product to have a standardised design, and excludes only cigars and pipe tobacco. Waterpipe tobacco is not excluded, and Kræftens Bekæmpelse, the Danish Cancer Society, states that waterpipe tobacco may be sold only in neutral, standardised packs. The ministerial order sets the exact design, so a branded tub built for another market cannot be reused.

Section 19 requires health warnings in Danish on each unit pack and any outer pack. Tobacco Control Laws summarises the smoked-tobacco rule as one of 14 combined picture-and-text warnings on 65% of the front and back of the pack, with general and information messages on the sides. The same source notes that the point-of-sale display ban applies except at specialist tobacconists, which affects how your Danish customers can merchandise the product.

20Flavours, additives and reporting

The characterising-aroma ban in section 14 of the act lists cigarettes, heated tobacco products and roll-your-own tobacco. In the consolidated act of 4 November 2024 that we reviewed, waterpipe tobacco is not named in it. Vitamins, caffeine, taurine and other stimulating additives are banned in all tobacco products under section 17. A September 2020 statement from the Danish health ministry said that flavours in waterpipe and chewing tobacco are not banned, because the EU directive prevents it. Since 1 July 2025 Denmark has applied a separate flavour ban to nicotine pouches and other tobacco surrogates, which allows only tobacco and menthol. If you supply tobacco-free shisha, ask your Danish importer whether it counts as a surrogate, and confirm the current text before you commit to a flavour range.

Manufacturers and importers of tobacco products placed on the Danish market must report each product by trade name and type to Sikkerhedsstyrelsen and the European Commission under section 3. The importer of record is the party that holds this duty.
