18Tobacco products tax

Revenue's Tobacco Products Tax page lists the rates in force from 8 October 2025. Cigarettes are taxed per thousand plus a share of the retail price, while cigars, fine-cut tobacco for rolling and other smoking tobacco are taxed per kilogram. The rate for other smoking tobacco is EUR 375.847 per kg. Revenue's page does not name waterpipe tobacco, so ask an Irish customs broker or Revenue to confirm that your product falls in the other smoking tobacco line before you agree a price.

The per-kilogram system means the tax does not depend on the pack price. As in other markets, compare offers tax-paid and agree who is the tax debtor for each shipment.

19Plain packaging and health warnings

Section 2 of the Public Health (Standardised Packaging of Tobacco) Act 2015 defines a tobacco product as a product that can be consumed, consists even partly of tobacco and is intended for sale by retail in the State. The Act sets standardised-packaging rules for cigarettes (section 7), roll-your-own tobacco (section 9) and other tobacco products (section 10). We found no provision in the text that exempts waterpipe tobacco. Tobacco Control Laws records that plain packaging became mandatory on 29 September 2018 and applies to tobacco products sold in Ireland. Treat an Irish shisha pack as a standardised pack with no branding, and ask the HSE or your Irish importer for the detailed specification in the 2017 regulations before you design artwork.

Smoked tobacco packs must also carry one of 14 combined picture-and-text health warnings covering 65% of the front and back, with a general warning and an information message on the sides. This follows the EU Tobacco Products Directive, which the 2016 regulations transpose.

20Retail licensing through the HSE

Under the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023, retailers of tobacco products need a licence from the HSE for each shop and for each website that sells online. The HSE states that the fee is EUR 1,000 for tobacco products, the licence lasts 12 months, and applicants need a valid tax clearance certificate from Revenue. One trade report cites a penalty of up to EUR 4,000 or six months' imprisonment for selling without a licence.

The HSE page we reviewed describes the licence for retail sale and does not address wholesalers separately. Before you supply an Irish shop or lounge, ask for a copy of its licence.
