Under the Polish Excise Act, waterpipe tobacco is taxed as smoking tobacco. A 2018 individual tax interpretation, which applied article 98(8), states that products made wholly or partly from substances other than tobacco, but otherwise meeting the criteria, are treated as smoking tobacco, and that the tax base is the total weight of all components. Article 99(2)(2) sets the rate as a per-kilogram amount plus a percentage of the maximum retail price, which the producer must print on the unit pack (article 99(7)).
The consolidated text of the Act in Dz.U. 2026 poz. 412, as shown by two legal-information sites, gives the rate for smoking tobacco as 412.58 PLN per kilogram and 32.05% of the maximum retail price. The Government's 2025 legislative project says the per-kilogram part rises by 38% in 2025, 30% in 2026 and 22% in 2027, and other secondary sources show a lower amount for 2026. We could not read the official gazette, so treat the amount as an indication and ask your Polish importer or broker for the figure in force on the import date. The interpretation quoted here is from 2018 and predates these increases.
